Das Verhaltnis von Regel und Fall ist ein Grundthema der Rechtsphilosophie und der juristischen Methodenlehre. Im Zentrum stehen dabei meist Probleme der Regelanwendung. The original article published in volume 10 issue 2 on pp. 143–155 had an error. Table 1 headers “Mobility assistance” and “Automated toilet” were inadvertently removed, while the headers “Movement actuation” and “Conversation partner” were in the wrong columns.

Ambient assisted living technologies are expected to solve a significant number of problems related to elderly care. However, in Japan, limited discourse on the ethical issues concerning their application is hindering the spread of AAL technologies. Against this background, this study explores the ethical perspectives of AAL technology engineers in Japanese companies and the circumstances influencing their perspectives. A qualitative study using semi-structured interviews was conducted. Nineteen Japanese AAL-technology companies were contacted, and nine of them and their engineers responded to (...) the interviews. The contents of the interviews were analyzed with thematic analysis which showed that the engineers had ethical concerns about their products as follows: safety and related conflicts, acceptance of the technology, dependence on the technology, accident liability, fair access to the technologies, and privacy. In relation to these issues, they identified as company employees with regard to the following: responding to social needs, having many users, and cost reduction. They also mentioned being influenced by the Japanese national program for AAL-technology promotion. The engineers experienced dilemmas between the various stakeholders’ interests and they hoped that ethical guidelines for developing AAL technologies would resolve such dilemmas. In conclusion, Japanese AAL-technology engineers tackle ethical issues with regard to the application of their products. The engineers hope for the establishment of guidelines for the ethically responsible development of AAL technologies. The guidelines need to be established and implemented in an interactive manner, in order to avoid their being reduced to a bureaucratic formality. (shrink)

The dispute between naturalism and anti-naturalism has been underway almost since the very beginnings of philosophy. Christian thinkers, by proclaiming that God as Creator transcends the reality He has created, and that human beings as persons transcend the material world, have entered this dispute on the anti-naturalist side. The contemporary dominance in culture of the naturalistic paradigm requires Christian philosophy to reflect on naturalism in the broadest sense (in its various forms), together with its conditions and consequences, and to rethink (...) its relationship to this philosophical tradition. Naturalism rejects the possibility of something existing, being known, or being explained that is separate from the material reality given in empirical cognition. Along with this, it denies human beings transcendence with respect to the natural or social world. In its contemporary iteration, this tradition appeals to the solutions and methods of domain-specific forms of scientific inquiry, relying on them for its own authority. For Christian philosophy, naturalism represents a powerful challenge. It is possible to see in it a threat to Christian philosophy, but it is also possible to discern in it an opportunity for a more critical evaluation of Christian philosophy’s previous solutions, and an opportunity to develop new ones. There is a need for a better understanding of naturalism itself, as well as of what the various domain-specific sciences (including the natural and social sciences, as well as the humanities and, currently, neuroscientific research in particular) have to say about the world and about human beings. Systematic and historico-philosophical questions equally still call for debate – in relation to the centuries-old dispute between naturalism and anti-naturalism, as well as the changing place of Christian thought within it. In our own time, one can witness diverse attempts by Christian thinkers both to critically discuss naturalistic positions and to implement naturalistic approaches or solutions within Christian thought itself. Certainly, the latter cannot ignore the fact that naturalism allows philosophy to maintain cognitive contact with domain-specific forms of scientific inquiry. The organizers plan to conduct this conference in hybrid mode, combining both online and onsite elements. The Y chromosomes of most Drosophila species are necessary for male fertility but they are not involved in sex determination. They have many puzzling properties that resemble the effects caused by B chromosomes. Classical genetic and molecular studies reveal substantial affinities between Y and B chromosomes and suggest that the Y chromosomes of Drosophila are not degenerated homologues of the X chromosomes, but rather that their Y chromosomes evolved as specialized supernumeraries similar to classical B chromosomes.

English summary: Natural church law was the central discussion forum for questions of religious policies in the 18th and early 19th centuries. In this section of secular natural law, very diverse protagonists discussed the sovereign's claim to power over the church, the freedoms enjoyed by the clergy, the demand for religious freedom and democracy within the church. German description: Unsere Vorstellungen vom Verhaltnis von Staat und Kirche werden entscheidend von der Rechtsphilosophie des 18. und fruhen 19. Jahrhunderts bestimmt. (...) Das epochepragende sakulare Naturrecht widmete sich staatskirchenrechtlichen Fragen im Teilgebiet des anaturlichen Kirchenrechts. Dessen Anhanger leiteten aus ubergeordneten Vernunftgrunden Regeln ab, die - im Gegensatz zu den besonderen Rechtsordnungen einzelner Kirchen - fur alle Religionen Gultigkeit beanspruchten. Die Kirche galt einerseits als eine mit autonomen Befugnissen ausgestattete Gesellschaft; ihre Existenz im Staat machte sie andererseits zum Objekt staatlicher Hoheitsrechte. Angesichts der Globalisierung und der von ihr aufgeworfenen Probleme für das nationale und das internationale Recht gewinnt die Rechtsphilosophie immer stärker an Bedeutung. Wu, spAter Verfechter einer dynamischen Naturrechtslehre, versucht, die mehr pragmatisch-funktionale Rechtsauffassung der fA1/4hrenden amerikanischen Rechtsgelehrten mit dem von Kant geprAgten Denken R. Stammlers zu einer inneren Begegnung zu bringen. Gleichzeitig ist die Thematik chinesischen (...) Rechtsdenkens und Philosophierens immer gegenwArtig. Although Hegel is increasingly recognized as an important figure in the history of political economy, his economic views are never strictly economic. In contrast to other modern thinkers, his primary concern is not the economic efficacy of different practices or institutions but the extent to which they enable and promote the development of human freedom. In this article, I argue that Hegel's pioneering critique of modern liberal economy plays out simultaneously at a more empirical level, corresponding to the properly economic (...) dimension of his analysis, and at a deeper, logical level, which grounds and guides his position. Moreover, I argue that the tendency to favour the first of these levels, found in most of the literature on Hegel's economic thought, reduces the Philosophy of Right's main argument to a more or less vigorous plea for economic interventionism. Against this kind of reading, I show that a renewed focus on the text's logical structure reveals a different and more radical philosophical proposition, which has yet to be fully acknowledged. In particular, I argue that Hegel's dialectical logic leads him beyond the liberalism-interventionism debate, towards a qualitatively different conception of social and economic relations. (shrink)

Zusammenfassung Der Beitrag legt Befunde zur Beteiligung von 15-jährigen Jugendlichen mit Migrationshintergrund am vereinsorganisierten Sport vor. Die Sportvereinszugehörigkeit wird aus einer geschlechterdifferentiellen Perspektive analysiert, aber auch mit der sprachlichen Akkulturation und der sozialstrukturellen Integration der Familie in Beziehung gesetzt. Die Ergebnisse zeigen, dass es sich bei den Jugendlichen mit Migrationshintergrund um eine sehr heterogene Gruppe handelt, die in Teilen durch eine sehr große Nähe, in Teilen aber auch durch eine sehr große Ferne zum Vereinssport gekennzeichnet ist. Vor allem bei den (...) Mädchen wird der Zugang zum Sportverein stark von sozioökonomischen Lebensverhältnissen und von den kulturellen Normalitätsmustern der Familie mitdefiniert. (shrink)
